REGISTRATION & MEDIA RELEASE

Dear Parent/Caregiver,

    Due to the nature of our programs, all of our films are uploaded onto our Young Moviemakers YouTube account. Only first names are included in our credits on YouTube; however, some festival entries and other exceptions may ask for last names. We understand that there may be some concerns regarding releasing images onto YouTube but unfortunately, this is the best way we can share and distribute films to participants. If Young Moviemakers does not receive media consent for each participant, please be aware that we must find a way to hide your child’s images on camera by avoiding filming them directly or putting them in a mask.

1. THE UNDERSIGNED HEREBY GRANTS Young Moviemakers and their partners, the absolute right and permission to use and re-use, in whole or in part, the name, voice, images, likeness and artworks of the person named in this release. Such videos and artwork produced or provided for use at any point during the course of a Young Moviemakers program, are granted use in any and all media worldwide in perpetuity for any and all legal purposes, including advertising, promotion, records, public relations or internet programs, without payment or notice to the undersigned.
    

2. THE UNDERSIGNED HEREBY CONSENTS that Young Moviemakers is the owner of all intellectual property rights to the artworks produced during this program, the videos and all film, footage, recording, soundtracks, images and reproductive product (including any digital reproductions) arising out of the videos and artwork (the “Intellectual Property), and the undersigned hereby unconditionally waves any and all personal and proprietary right, including all moral rights, that the undersigned may have in the Intellectual Property.
    

3. THE UNDERSIGNED HEREBY UNDERSTANDS that any such materials (video, audio, film or any other media) will be used only for the purpose of promoting the program and its participants, at festivals, screenings, broadcast, program promotions and distributions. It is also understood that any such materials will be used with the highest integrity and discretion, with the intent to communicate responsibly and ethically, the subject matter contained therein.

Waiver of Liability and Indemnity Agreement

    In consideration for being permitted to participate in the programs provided by Young Moviemakers, including but not limited to observation or use of facilities or equipment, the undersigned, for himself or herself and dependent minors, personal representatives, heirs, and next of kin, hereby acknowledges, agrees and represents that he or she understands that despite the highest level of safety practices employed at Young Moviemakers, accidents can possibly occur. Therefore:

1. THE UNDERSIGNED HEREBY RELEASES, WAVES, DISCHARGES AND COVENANTS NOT TO SUE Young Moviemakers, its directors, officers, employees, volunteers, interns and agents (hereinafter referred to as “releasees”) from all liability to the undersigned, his personal representatives, assigns, heirs, and next of kin for any loss or damage, and any claim or demands on account of injury or death to the person participating in the program, whether caused by the negligence of the releasees or otherwise while the undersigned is in, upon, or about the premises or any facilities or equipment therein.
    

2. THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may incur due to an injury or accident.
    

3. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE due to negligence of releasees or otherwise while in, about, or upon the premises of Young Moviemakers and/or while using the premises or any facilities or equipment theron on participating in any program affiliated with Young Moviemakers.
    

    THE UNDERSIGNED further expressly agrees that the forgoing MEDIA RELEASE, WAIVER AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the law and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. 

 

    THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.
