Young Moviemakers x TWU Media Release

Dear Parent/Caregiver,

Due to the nature of our programs, all of our films are uploaded onto our Young Moviemakers YouTube account. Only first names are included in our credits on YouTube; however, some festival entries or other exceptions may require full names. We understand concerns regarding posting images on YouTube; however, this is the primary way we can share and distribute films to participants. If Young Moviemakers does not receive media consent for a participant, we will take steps to protect their privacy by avoiding filming them directly or requiring them to wear a mask.

1. THE UNDERSIGNED HEREBY GRANTS Young Moviemakers and its partners the absolute right and permission to use and re-use, in whole or in part, the name, voice, images, likeness, and artworks of the person named in this release. All videos and artwork produced or provided during the course of a Young Moviemakers program may be used in any and all media worldwide in perpetuity for any legal purpose, including advertising, promotion, records, public relations, or internet programs, without payment or notice to the undersigned.
    

2. THE UNDERSIGNED HEREBY UNDERSTANDS that Young Moviemakers may use digitally assisted tools during the filmmaking process for editing, visual effects, animation, or sound enhancement, which may include Artificial Intelligence (AI). These tools may analyze or process participants’ images, voices, or performances solely to create artistic or educational content.
    

3. THE UNDERSIGNED HEREBY CONSENTS that Young Moviemakers is the owner of all intellectual property rights to the artworks produced during this program, including all videos, film, footage, recordings, soundtracks, images, and reproductions (including digital reproductions) arising from such materials (the “Intellectual Property”), and hereby unconditionally waives any and all personal and proprietary rights, including moral rights, in the Intellectual Property.
    

4. THE UNDERSIGNED HEREBY UNDERSTANDS that such materials (video, audio, film, or other media) may be used only for promoting the program and its participants, at festivals, screenings, broadcasts, program promotions, and distributions, with integrity and discretion.

Waiver of Liability and Indemnity Agreement

​

In consideration of being permitted to participate in programs provided by Young Moviemakers, including observation or use of facilities or equipment, the undersigned, for themselves and any dependent minors, personal representatives, heirs, and next of kin, acknowledges and agrees that despite safety practices, accidents can occur. Therefore:​

1. THE UNDERSIGNED HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Young Moviemakers, its directors, officers, employees, volunteers, interns, and agents (the “releasees”) from all liability for any loss, damage, or claim arising from injury or death to the participant, whether caused by the negligence of the releasees or otherwise, while in, upon, or about the premises or any facilities or equipment therein.
    

2. THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY AND HOLD HARMLESS the releasees from any loss, liability, damage, or cost incurred due to an injury or accident.
    

3. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY AND RISK of bodily injury, death, or property damage due to the negligence of the releasees or otherwise while in, upon, or about the premises of Young Moviemakers, or while using any facilities, equipment, or participating in any program affiliated with Young Moviemakers.
    

THE UNDERSIGNED FURTHER AGREES that this Media Release, Waiver, and Indemnity Agreement is intended to be as broad and inclusive as permitted by law, and if any portion is held invalid, the remainder shall continue in full legal force.

THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS this Release and Waiver of Liability and Indemnity Agreement, and acknowledges that no oral representations, statements, or inducements apart from this written agreement have been made.
